The IRS doesn't create the tax code, Congress does. The IRS just implements the laws Congress passes. Pretty typical Rummy, say something that will rile a lot of people up but has very little real effect. Neither accurate nor precise.
Rumsfeld never said the IRS created the tax code. However, in fact, the IRS does create the tax code! The Congress passes legislation defining in very broad strokes what the IRS is supposed to do, and the IRS' analysts turn that into the monster known as the Tax Code. But these are quibbling points. What Rumsfeld is complaining about is the complexity of the tax code, without regard to whose fault it is (read it carefully - he never accuses anyone). The IRS is charged with enforcing the tax code, and he is simply pointing out that it is so complex that nobody could reasonably know whether their return was accurate or not...
